- Our solicitor had an hour phone meeting with Atanas Kalinov billing manager (We will cover this in a separate newsletter)
SRIOC is currently defending the ETA’s AGM against Boyan’s appeal.
Our solicitor, appointed by the SRIOC, will defend against Boyan’s appeal of the recent AGM challenge. Boyan, who promised to support the owners if they received the majority of votes, seems to have broken his word. It is anticipated that Iva may not defend ETA, which could result in Boyan
regaining control, despite the majority of owners having won the AGM.
Iva, we’d like to inquire if you are defending the ETA AGM. If that’s not the case, could you explain why? Could it be because our members were elected to the controller board and management council, which may not have aligned with your agenda?
We are curious about why these expensive AGMs ultimately result in all parties spending tens of thousands of euros and now you may not defend them.
So, what was it all for?
It’s unfortunate that the opportunity for owners to gather was missed, and now it seems to have had negative consequences due to the calling of these AGMs and the insistence on owners paying these utility bills.
Iva, is well aware of where the SRIOC stands on her plan. We have made it very clear.
All owners need to unite together for the greater good and for the sake of our investments, this is what we should all agree on.
It is important for new owners to understand that Elite Homes rely on Sunset’s operation, which sets their interests apart from those who have been owners in Sunset for 15 years.
They are familiar with all of Boyan’s tactics and are determined to prevent a repeat of his actions. It’s not personal; Boyan’s intention is to create a situation where one owner is pitted against another, but it’s important not to let him succeed because there can only be one winner in that scenario. The desire to reopen the resort is understandable but must be balanced with fairness and responsibility. It is not acceptable to burden owners with excessive utility charges, bills that are not their responsibility, or unfair maintenance and management fees. We need a more equitable and transparent approach to running the resort. One that is not controlled by one owner.
Remember the SRIOC does not own the resort and does not have the keys.
Boyan made the decision to close his commercial and pool operations due to our refusal to cover the expenses of commercial and holiday companies anymore. Which was taken out of our MM fees. Additionally, the non-payment of utility bills was facing scrutiny from Europe and Bulgaria.
Unfortunately, he reacted impulsively and unprofessionally, much like a spoiled child who doesn’t get their way. No surprise there.
If you have any concerns about unpaid MM fees, contact Boyan Bonev at boyan@sunsetresort.bg and inquire about the half million euros in MM fees that he is responsible for paying each year for his commercial and holiday companies. You may also request a copy of the condominium bank account showing all paid MM fees. If you receive this information, kindly share it with the rest of the owners as it has not been made available so far. Regarding the issue of owners not paying their MM fees for 2023, our condominium manager, Manol Manolov, has made it clear that he will not be collecting these MM fees for 2023. He has also informed all owners that once all 2022 MM fees have been paid, he will reimburse those who have paid their 2023 MM fees. We find it quite puzzling – where could the money be? Shouldn’t it be securely deposited in OUR condominium’s bank account? It is the condominium of the owners, not Manol’s to decide when he gives this money back to the owners. However, no condominium bank has been ever set up or shown to owners so ask yourselves why? Some other questions that Boyan might answer for you.
This explains why our members are adamant about not paying any bills to Sunset until we receive audit accounts all bank accounts and direct utility connections.
Perhaps, if Iva first begins collecting the MM fees from Boyan, she would have enough to pay off these utility bills. Boyan’s share of the MM fees is 500,000 euros annually as he owns one-third of the resort. Additionally, he is also responsible for paying the MM fees for the 82 apartments and villas he owns. Once his share is collected, there should be plenty of money to cover all the debts.
As owners, we should be all united, but it’s important to note that we won’t be responsible for paying these bills which are legally not ours. If Iva decides to take on these expenses with her members, please keep in mind that our members won’t be contributing.

Information from our solicitor on a recent meeting with the mayor of Pomorie.
Dear Sunset Resort Owners,
We hope this newsletter finds you well. We have some significant updates to share regarding recent developments at Sunset Resort. Please take a moment to go through the following information.
- Encouraging Discussions with the Mayor: During a recent unexpected meeting with the Mayor of Pomorie, we had the opportunity to discuss the issues at hand. We convey our concerns about the current state of Sunset Resort, emphasizing its importance as a vital business centre and employment hub for the community. We also informed the Mayor about the petition we have filed with the European Parliament. However, we believe it is crucial to address the local aspects of the situation directly. To that end, we proposed filing a petition with the local parliament, seeking their formal support alongside the citizens of Pomorie. The Mayor responded positively and suggested that this should be a non-partisan effort, focused on unity rather than political divisions.
- Legal Matters and Monopoly Abuse: We raised the issue of potential abuse of monopoly positions by EVN (the electricity company) and VIK (the water company). The Mayor acknowledged these concerns and expressed a willingness to share any relevant information on complaints against these companies. He explained that other citizens have very identical issues. This collaborative effort will help us shed light on any unjust practices and seek appropriate resolutions. The mayor’s office as a result has sent in the same day a copy of legal cases of people who have the same issues.
- Iva Meeting and Legal Perspective: We find it deeply concerning that the recent Iva meeting lacked competent legal representation to challenge and ask pertinent questions to the EVN team. For instance, the High Administrative Court has explicitly stated that individual connections must be ensured, and if a third-party network exists, contractual agreements or regulatory interventions are required to ensure fair access to the infrastructure. This highlights the basis of our complaint to the EU Parliament. When a functional electricity installation is already in place, there should be no requirement to lay new cables. Utilizing the existing infrastructure is the logical approach. It is important to note that EVN’s stance, relying on a regulation that contradicts EU law, is legally unsound.
- Engaging the New Government: With the recent formation of a pro-western government in Bulgaria, we have an opportunity to address the current situation promptly. We propose reaching out to the new Minister, highlighting the urgency of resolving the issues at Sunset Resort.

Information on VIK Water company
Dear SRIOC,
I hope this letter finds you well. I am writing to provide an important update regarding our ongoing efforts to secure electricity for the building. While this remains a priority, I would like to emphasize that the issue of individual access to water is equally critical, if not more so.
It is important to note that these two services have a fundamental difference. The electricity supply is managed by a privately owned corporation, EVN. On the other hand, the water supply is overseen by the state-owned VIK Water company, which is owned by the State.
With regard to our plan for individual water connections, we have not received a formal refusal, as stated in the email received by Mrs. Ivalina. However, there are several requirements that necessitate the active cooperation of the Water company management. I have attached the official demand for water connection in a separate file for your reference.
Among the requirements, two key aspects require attention from the Water company:
1. The situation with the external plumbing connection must be agreed upon with the Water company.
2. A drawing of the agreed water meter unit for the water connection is needed.
Given that the water company is state-owned, this issue has political implications, and it falls under the purview of the Ombudsman. It is important to note that the Ombudsman is competent only in cases involving relationships between the state and individual persons.
To address these challenges, we are planning to arrange meetings with the relevant authorities, including the President of the Water company and EVN.
Additionally, we need to reach out to the new minister, considering that Bulgaria is currently undergoing a political transition, and a change in power within the Ministry is expected. It is worth noting that the Ministry of Regional Development of the Republic of Bulgaria is the sole owner of the capital of the Water company.
As part of our plan, I have included an email that everyone can send to the water company’s email address. This email aims to raise awareness about the issues faced by multiple owners who are seeking access to water. Furthermore, I have attached a separate PDF document that contains the original document required for the actual water connection. I have prepared an English version of the document for your convenience. Please note that this document is meant to be filled out manually, although there is also an option for electronic submission that requires a qualified electronic signature.
In conclusion, I kindly request your support and cooperation in our collective efforts to resolve the water access issue. Together, we can ensure a secure and reliable water supply for all owners. As discussed in our previous newsletter owners need to apply to EVN electricity company for direct connection NOW if you have not already done so.
All owners need to apply ASAP. We need to show EVN that all owners are serious about receiving their own electricity meters.
This is the only way owners are going to reclaim their property rights over their apartments.
The following needs to be completed as soon as possible.
To show the electricity company EVN that “Times – they are a changing“ and as independent apartment owners, we are applying for our full property rights of opening individual accounts on mass.

This is totally unacceptable to me, I need to gain back control of my independently owned apartment and have a contract with your company, not rely on a third party management company that I have no contract with for supply of utilities, that cannot pay its bills and effectively holds every apartment owner hostage!!
