Dear Owners

We would like to advise owners of the following information so they can make an informed decision about Iva Parusheva’s offer to get Sunset Resort opened again.

SRIOC comments

235 contracts have been signed with apartment owners,

As requested before, please give us a list of these apartment numbers and proof they have paid any money over to your bank account. As anyone can sign contracts.

SRIOC members have requested a copy of this contract and have not received a copy. Why?

We managed to get a copy through other channels.

The decision to sign a contract with Elite Homes and their business partners is entirely up to every owner, but here are a few things to consider.

If owners sign this LEGAL document, you are committing yourselves to the conditions of this contract, which leaves you LEGALLY bound by it. The only way out of this contract is for you to take legal action. Our members are well aware of this procedure, as back in 2010, members had to get out of the “slave” contract with Sunset management.

That is why our members will not make that same mistake twice. “Once bitten twice shy”.

This is what Boyan and Iva want, so if you do not obey this contract, they can take you to court which they will as you have signed this contract. This will allow them to put a lean onto your apartment enabling them to recoup costs and penalties.

Your apartment will be put into the hands of the bailiff.

If you do not pay the Sunset utility bills and any future bills which Iva is committing, you too. You will become liable through this contract. So be very careful what you sign up to.

Remember, THESE BILLS ARE NOT OURS. They are Sunset Utilities owner TODOR VELIKOV PANAYOTOV capital (50 euro), who was an employee of Boyan.

Ask Iva why she has not got the biggest investor – Boyan Bonev, to pay for his 82 apartments, villas, bars, restaurants, spas, and rental companies. Surely, he wants to pay his fair share??

Ask yourselves why?

Because Boyan has no intention of paying these bills – which he has made very clear. So why should we? One rule for us and one for him. We don’t think so.

Once fooled shame on you , fooled twice, shame on me.

Boyan want’s the owners to pay and Iva is the debt collector.

This is Bulgarian businesses at play.

In the past Boyan would have cut off owners’ power and water illegally. This was until Clare Daly MEP put a stop to this. Boyan’s new plan is to not pay these bills. Then EVN and Vik will do his dirty work for him. Which already they have even tough owners have paid for their consumption.

Where is that money?

So, it seems Boyan has a separate meter and separate billing! However, owners are in battle to have their own meters and direct billing.

This is proof that it is possible. As if not, he would be disconnected

What service is that for owners?

It is just greed – to open Sunset for Iva and other selling agents to make money on selling your apartments as owners are becoming more desperate to sell.

The SRIOC is receiving emails from Iva’s friends saying just pay and sell your apartment if you don’t like it. How dare they. When they have gone through what we have over the years then come back to us.

We stress once again to Iva and her business partners that the SRIOC committee works voluntary and are not paid, unlike yourselves with your big commissions and the taking of MM fees and roof charges from owner’s sales when they were not legally due. More debt collecting!

We also got commitment from Mayor Aleksiev to help – so no news there. Iva, please don’t confuse the owners with stating that the Mayor Aleksiev is making legislative changes, these changes are nationwide – from the Bulgarian government and not just for Sunset Resort. The new legislation is on the Condominium Act. This will also give all owners the right to vote online from the comfort of their home whenever AGMs are called so their voices can be heard! Unlike the AGM’s you and Boyan called when owners could not travel or when there were no direct flights!

Let us be very clear all our members have always acted within Bulgarian law to state otherwise is just not true.

Not like many in this situation we could mention.

Photo 1. Swimming pools not our responsibility. This is after we stopped 750,000 euros being taken out our MM fees for the rental of these pools for 4 months a year .Most expensive pools in the world. Sunset received this amount every year for 13 years. We well paid for their water park. This was illegal and which the courts agreed with us.

It is great to see that they have resurfaced all around the pool and taken away the broken tiles. So that is a plus for Boyan.So this is an improvement so not a negative???

Photo 4. ETA photos shows the same situation for the last 8 years.Nothing new here.Even when they received 2.2 million euros in MM fees from owners across Phase 1 and Phase 2. What was their excuse then?You have seen the photos we sent over the years it’s well documented.

Ask, Manol and Boyan why this work was not completed.

You are directing your anger at the wrong people.

Photo 5. ETA as all owners know this has been like this over 10 years when all owners were paying 2.2 million euros a year and nothing was done. So, what is your point.

Photo 6. Alpha building This plaster fell over 8 years ago and nearly missed owners on their balcony. These repairs were reported to Sunset resort management numerous times, and nothing was done when they were getting millions of euros in MM fees.

So, nothing new here.

 

Our solicitor’s comments

We trust this communique finds you steadfast and united in our joint quest for justice, transparency, and safeguarding our financial stakes. Today, we’d like to draw your attention to a contract proposal from Iva Parusheva, shedding light on its fundamental shortcomings and possible impacts on every Sunset Resort stakeholder. It’s of paramount importance that we thoroughly scrutinize each proposal to guarantee our shared benefits are not compromised.

Crucial Issues to Take Into Consideration:

Lack of Strong Groundwork: The suggested contract doesn’t provide a robust groundwork for sustained stability. It overlooks the crucial aspect of payment assurance, rendering us susceptible to future financial obligations and interruptions in services. Absent a resilient system guaranteeing consistent and dependable payments, we stand a chance of falling back into financial chaos, threatening our investments and resorting to temporary fixes. As an example if payment is made at this very moment the electricity supply will be restored. The question arises what will happen next month. Who is going to pay the consumption for the next month? Who will be the contracting party to pay for electricity? How can we guarantee that what every customer pays for electricity and water on a daily basis will be forwarded as payment to EVN and the Water company?

Questionable Commitment: Despite the contract’s claim to ensure personal electricity access, recent maneuvers by EVN, the electricity provider, contradict this promise. Their adamant stance on building new infrastructure, ignoring the court’s ruling favoring existing infrastructure, casts a deep shadow of doubt on their dedication to grant individual access rights. Also the non payment of EVN bill is not the reason for lack of individual connection. The refusal of individual connection is predated by years the current situation of unpaid current bills by Sunset Utility.

We should exercise caution before placing faith in a contract that might not fulfill its promises.

Concealed Responsibilities and Restricted Funds: A glaring deficiency in the proposed contract lies in its potential to freeze funds and impose unexpected financial burdens on stakeholders, including Iva Parusheva. In the absence of explicit protective measures, the lack of fund management and uncertainty over their distribution pose significant hazards. We should prioritize a more secure and accountable financial structure to shield our investments from potential burdens. What will happen to Iva Parusheva if she transfers money to EVN and the EVN management comes with even more ridiculous demands and despite everything there is no real commitment?

Immediate Fixes, Potential Long-Term Impact: While the proposed contract seeks to resolve immediate issues, it doesn’t offer a well-rounded strategy for long-term stability and efficient utility management. Real solutions demand a comprehensive view that includes ongoing maintenance, fair pricing, and clear governance. We should aim for more than just temporary relief and work towards a contract structure that guarantees the conscientious management of Sunset Resort, preserving our investments.

In Pursuit of a Better Future:

As conscientious stakeholders, it is our obligation to closely examine any contract proposal, understanding its possible consequences and insisting on all-encompassing solutions. Our focus should be on contracts that guarantee regular, dependable payments, ensure personal access to utilities, and set up a sustainable framework for managing the resort.
