AGM’s
The AGMs for Sunset Resort were held on Thursday and today, and our solicitor attended these meetings on the owner’s behalf.
Once the minutes are released, in accordance with the Condominium Act, the Act requires the minutes to be provided to all owners within two weeks. Following this, we will update all owners with a report.
INFORMATION FROM OUR SOLICITOR
I’m reaching out to bring you up-to-date with our ongoing appeal against the decision of the Bulgarian Water and Energy Regulatory Commission. This issue ties into our larger petition to the European Union (EU) regarding your rights to receive a consistent and fair electricity service. ( IT IS IMPORTANT THAT ALL OWNERS, FAMILY AND FRIENDS TO SUPPORT OUR EU PETITION)
Let’s break this down a bit:
- What’s the Issue? , The Energy and Water Regulatory Commission (EWRC) decided to stop investigating our complaints about your electricity supply problems. We strongly disagreed with their decision, because it’s not fair and it’s against the law – both Bulgarian and EU laws.
- Why is it Against Bulgarian Law? We’ve already won in the high court before, and- the court agreed that your properties should receive electricity. But the Bulgarian commission ignored these court decisions. That’s not how things should work. The Energy and Water Regulatory Commission (EWRC) should have enforced the high court decision for EVN to connect all owners to electricity.
- How Does it Violate EU Law? In the EU, everyone has the right to essential services like electricity – it’s called “Universal Service Rights”. These rights mean you should be able to use electricity like any regular household, know how much you’re using, pay fair house prices, and choose your own electricity supplier. The Bulgarian Commission’s decision is stopping you from exercising these rights.
- Is There Any Good News? Absolutely! Interestingly, the Energy and Water Regulatory Commission‘s (EWRC) decision has actually helped us. It’s a clear example we can show to the EU to prove that Bulgaria is violating the Universal Service Rights law. This makes our EU petition stronger.
- We have recently appealed the case against EWRC Energy and Water Regulatory Commission again to the Sofia administrative court, which is up again in court in October which will tie nicely in with our EU petition. We will keep you updated on the progress of this.
- Our goal is simple: to ensure you get your rightful, legal connection to the electricity supply, at a fair price, and with the freedom to choose your supplier. We believe in your rights and will continue to fight this case on your behalf. Thank you, for your continued patience and trust in us. We will keep you updated with any new developments.

ETA owners are fully aware of the situation and aware weeks before your statement maybe your moles were off that day.
It is highly disappointing to read the threatening tone of your recent emails. Your behaviour towards fellow owners is a true reflection of your character. If owners who have entered into a signed contract with you, should be very unsure if it was a wise decision but never too late to cancel it before it’s too late.
If this is how you treat owners now, we shudder to think about what the future holds if you were ever to succeed. We thought Boyan was intolerable, but it seems like you are no better.
Your threats against property owners for unpaid MM fees for 2021/22 cannot be enforced since you are not the managers, even after your unsuccessful attempt during last April’s AGM.
Owners who invoked Art. 51 are exempt from paying MMs if they did not use their apartments for more than 30 days. The law of your country.
We will wait and see if you follow through on your promise to open the resort on September 20th, as you have stated this multiple times in the past with no joy. After you settle the EVN and VIK bills, which you and your members are so generous in paying, they are not the responsibility of all owners.
Remember, It’s essential to have enough funds to cover future EVN and VIK utility bills once you turn on the lights and water supply once you open the resort on the 20th of September.
It is important to understand that by signing up for your plan, owners become responsible for all future bills. If these bills are not paid, EVN and VIK will hold them responsible as those owners signed contracts and who also agreed to take over the bills. In such a scenario, the owners who signed these contracts will be held accountable and taken to court for unpaid bills.
As the SRIOC and its members have stated repeatedly, they want independent property rights to ALL apartments and independent access to utilities.
SRIOC and its members want a fair deal for all owners, but we are not giving up our rights to utilities and accountability. If you are interested in this, please give us a call.
We advise all property owners, regardless of their stance or what side of the fence they are on (pun not intended), to sign our EU petition. The petition is aimed at asserting our right to access our own utilities, as stipulated by Bulgarian and EU laws. The petition is anonymous, which means that your support will remain private

Step 2. Complete the Registration Form in full, take note of your Username and Password and submit the form. *Make sure to complete the captcha challenge successfully and agree to the privacy policy statement

Step 3. Check your mailbox for an activation email with a link you should click before you are able to access your account. *The email may take around 1 minute to send. Check your spam folder if you haven’t received it to your inbox.

Step 4. Once you have activated your account in the step above, Login to the site (click here) with the credentials set during Step 2.
Step 5. Go to “Find a petition” in the Nav bar and search for the Petition number 0442/2023 and follow the steps (or click here to jump directly to the Support page)


Step 6. Click through to Support the petition (by clicking two buttons “Support”) and you should receive a confirmation message when completed.
